Minimum deposit in the amount of $1,000.00 must be received at the time of signing to secure the date.

Final payment shall be due and payable no later than 90 days prior to the event.


Certificate of Insurance must be in the Masonic Temple office no later than 90 days prior to the event.


No terms are implied or granted and no work will be allowed to commence until full payment and Certificate of Insurance are received. 


Pay by Personal Check, Cash, Cashier’s Check, Money Order or ONLINE.  


RULES

By signing the Rental Agreement, it is agreed that the Lessee:

a.    Shall return said premises in the same condition as received;
b.    Shall not use adhesive tape (except for blue painter’s tape or gaffer’s tape), staples, pushpins, screws, hooks, nails or brads of any kind to affix objects or decoration to any portion of the building;
c.    Shall clean off all tables and clear all paper/trash from floors;
d.    Shall be responsible and liable for all damages caused by Lessee, their guests, visitors, employees, and  independent contractors (including, but not limited to performers, caterers, and bartenders);
e.    Shall strictly supervise all children under the age of eighteen (18) years. Any child not supervised will be required to leave the premises along with their parent or responsible adult.
f.    There is to be no construction of decorations, stages, etc. within the building without the direct approval and/or supervision of the Building Manager. Everything must be disassembled and removed by midnight unless a later date and time are approved by Building Management.

 

INSURANCE

Commercial General Liability insurance is required of Lessee and is due no later than ninety (90) days prior to rental date. The insurance must, at Lessee’s sole expense, provide and maintain general liability insurance, insuring the Lessee and the Masonic Temple Association of Sacramento and its employees, contractors, and contracted vendors against all bodily injury, property damage, personal injury, and other loss arising out of Lessee’s use and occupancy of the premises, or any other occupant on the premises, including appurtenances to the premises and sidewalks. The insurance required hereunder shall have a single limit liability of not less than $1 million, and general aggregate liability of not less than $1 million. The Masonic Temple Association of Sacramento shall be named as an Additional Insured of said policy, and the date and times of coverage should apply to all times the Lessee and helpers and vendors are on the premises.


If alcohol is to be served please make sure that the policy includes Host Liquor Liability coverage to protect you against alcohol-related accidents, as you are ultimately liable for the safety of your guests. 


If you are allowed in prior to your scheduled event date to prepare or decorate, you must be sure your insurance certificate provides coverage during that time. 

 

SPECIAL ENTERTAINMENT PERMIT

Sacramento City Code Chapter 5.108 is designed to hold entertainment providers responsible for patron conduct by making provisions for security, crowd control and minimizing disturbances.  This code chapter can be found on the internet at the Sacramento City Code website.  

 

“Unless exempt pursuant to Section 5.108.040, it is unlawful for any person to provide or permit any entertainment that is     open to the public without an entertainment permit issued pursuant to this chapter.”  Therefore, if your event is open to the public, you must obtain a Special Entertainment Permit. See Sacramento City Code Chapter 5.108.040 for exemptions. By signing the Rental Agreement, the Lessee agrees to be completely and solely responsible for meeting the permit requirements.


The Permit Application process may take as long as 45 days, so allow enough time so that the permit is available to us 30 days in advance of the event.  Part A of the Application will require our approval and signature.  Part B of the Application will require information from us on the company providing security.

 

CANCELLATION

Full payment of the Total Due shall be paid at least 90 days prior to the date of the event.  If full payment is not received at least 90 days prior to the date of the event, the Masonic Temple Association of Sacramento may, in its judgment, cancel the rental agreement and notify you in writing at the address on the rental agreement.  If the Masonic Temple Association of Sacramento elects to cancel the rental agreement due to failure to make timely payment of the rent due, a cancellation fee of the entire deposit will be imposed.


Cancellation by Lessee:  Notice of cancellation of the event or this agreement by you must be in writing and must be received by Masonic Temple Association at least 90 days before the date of the event.  


IF YOU CANCEL THE EVENT OR THE RENTAL AGREEMENT FOR ANY REASON,

A CANCELLATION FEE OF THE ENTIRE DEPOSIT WILL BE CHARGED AS LIQUIDATED DAMAGES.


If, for whatever reason, the event does not occur, you will be charged a Cancellation Fee of the entire deposit.  In all cases, the Security Deposit will be retained as all or part of the Cancellation Fee.  Violation of any provision of the contract shall subject you to loss of the entire deposit, at the discretion of the Masonic Temple Association of Sacramento.

INDEMNIFICATION

The Lessee shall indemnify and save harmless the Lessor, its officers, agents, contractors, and employees from and against any and all loss of, or damage to property, or injury to or death of any person or persons and all claims to damages, suits, legal and other costs, expenses, including, but not limited to attorneys’ fees, liability, actions or proceedings of any kind or nature whatsoever, in any way resulting from, directly or indirectly,  Lessee’s operation, actions or occupancy of the above-named facility, including acts of omission or omission of employees, representatives, agents, guests or patrons of the Lessee.

 

OTHER PROVISIONS

A.    Lessor agrees that the rental includes the use of the room or rooms described in section 1 of Rental Agreement and the adjacent kitchen, refrigerator, freezer, stove, dishwashing machine, tables, and chairs.  Said chairs shall be set up by Lessee. 

 

B.    Should Lessee, their vendors, guests, or visitors fail to vacate the premises on or before the time agreed upon, there shall be an additional charge of $500.00 per hour or any portion thereof.

 

C.    Lessee’s clean-up time is included in the time allowed in this contract under Section 1.

 

D.    The Security Deposit, after deduction for any damage or cleaning, overtime fees, shall be refunded within ten (10) days of the date of the event.  If, for any reason, the event does not occur, refunds will be made only in accordance with the Rental Agreement.

 

E.    If alcoholic beverages are served, they shall be served in accordance with the laws of the State of California.  Bar must stop serving 30 minutes before the event ends, but no later than 11:30 pm. 

 

F.    Lessee, their vendors, guests or visitors shall not use, occupy or enter any portion of the building not covered under this agreement. Lessee will be charged for using unauthorized areas if guests, vendors or visitors use rooms other than those that Lessee rented in this contract.

 

G.    There is to be NO OPEN FLAMES (except as approved on page 6 under #9) anywhere in the building, nor use of machines that produce FOG, HAZE, SMOKE, WATER VAPOR, BUBBLES, CO2 or DRY ICE. Helium balloons; confetti cannons or t-shirt cannons; throwing of sports balls or objects of any kind; drone flight; use of Pyrotechnics or Pyrotechnic-like devices which emit fire, sparks or any substance that may cause a fire; are not permitted anywhere in the building. These restrictions are necessary to avoid “breaking the beam” on the modern fire detection system and setting off the alarm, causing deployment of the Fire Department and evacuation of the building, which is mandatory to all persons and sensible whenever the fire alarm is activated. A charge of $500.00 for each of the first two False Alarm(s) will be deducted from the deposit, and upon the second occurrence, the event will be canceled and Lessee, vendors, and all guests and visitors will be asked to vacate the premises. In such cases, no refund of the deposit shall be made.

 

H.    Quinceañera and Sweet 16 events:

a.    Events are to be for one girl only.
b.    Event must have controlled entry. 

 

I.    No food or drinks of any kind are permitted outside the Ballroom.

 

J.    There is absolutely no drug use or smoking of any kind (cigarettes, cigars, pipes, vaping, e-cigarettes, etc.) tolerated anywhere in the building, including fire exit stairs and restrooms, or within 25 feet of the building. Disparaging remarks or any type of physical violence will not be tolerated and will be cause for immediate expulsion. Lessee and guests shall use the premises in a considerate manner at all times. Conduct deemed disorderly at the sole discretion of the Lessor staff shall be grounds for immediate expulsion from the premises and conclusion of the rental period. In such cases, no refund of the deposit shall be made.

K.    Lessee agrees that the Lessor staff may enter and exit rented areas during the course of the event. Representative(s) of the Masonic Temple will be on-site during your entire event and will be checking periodically with the responsible parties to ensure everything is running smoothly. We will also be checking the overall premises and rented areas, kitchen, and restrooms, replenishing paper towels, toilet paper and seat covers, collecting garbage and recycling, and will be available for questions or to respond to needs or issues that may arise at any time.

L.    Lessor takes no responsibility for stolen or damaged personal effects and possessions left on premises during or after any event. We do, however, maintain a lost and found and will hold recovered items up to 30 days. Every attempt will be made to return any recovered item to its rightful owner.

 

M.    Lessee agrees to comply with all applicable city, county, State, and Federal laws and shall conduct no illegal act on the premises. This is a drug-free and non-smoking facility at all times, NO EXCEPTIONS. Lessee shall not sell alcohol on premises unless properly licensed. Lessee may not serve alcohol to minors on the premises at any time. Lessee agrees, for everyone’s safety, to ensure alcoholic beverages are consumed in a responsible manner. Lessor reserves the right, in its exclusive discretion, to expel anyone who in its judgment is intoxicated or under the influence of alcohol or drugs, or who shall in any manner do or participate in any act jeopardizing the rights, use permit, or insurability of Lessor or the safety of its staff, guests, visitors or building contents.

General Agreement and Understanding by Lessee


Rules and Regulations Governing Use of the Masonic Temple Auditorium / Kitchen

1.    Caterers you employ must use the cooking surfaces in the kitchens:


    No Propane tanks are allowed inside the building!
    No Field Stoves fueled with portable pressurized gas bottles!
    No Charcoal Braziers or wood fires!  
    Fire Regulations do not allow these types of operations, described above, inside our building.
    Your caterer must be made aware of these regulations or they will be ejected from the building.

2.    Caterers you employ may not cook in the building, nor may they discard cooking oils in our sinks or garbage facilities.  They will be required to clean oil from the cooking surfaces and the floors.  Excess oils and fats must be removed from the premises by the caterer.

    Failure on the part of the caterers to clean up the kitchen after usage will result in the loss of your $1,000 deposit.
    Disposing of oils and grease in our garbage bins is prohibited and clean-out charges will result in loss of your deposit.

3.    Lessee will:

    Clean off all of the tabletops and pick up trash from the floor placing it in the trash bags provided for that use.
    It will be the responsibility of the Lessee to clean up liquid spills on the wood floor, when it occurs, in order to avoid staining, swelling, and other damage.
    Bars will be placed on rubber mats provided for that purpose and located on the tiled surface only.

4.    Regarding the decorating of the auditorium for your event:

    No Staples / Nails / Pushpins / Screws / Hooks / Brads / Hangers of any kind are to be used to hang your decorations.
    No Helium Filled Balloons -- they can “break the beam” and set off the fire alarm.
    Blue Painters Tape is acceptable to affix decorations to the walls and floors.
    Wire ties and pipe cleaners are acceptable to wrap-around rails.
    No construction will take place for stage(s), arch(es), backdrop(s), etc. without first obtaining permission from the Building Manager.

 

5.    You are responsible for the governance of serving alcohol to your guests and preventing SMOKING within the Building.

 

    We expect you to abide by the laws and regulations of the State of California when doing so.  Copies of licenses and/or permits will be provided by the Lessee along with the insurance certificate.
    You alone will be liable for lawsuits derived from serving minors who may become involved in traffic or public confrontations.
    If you are going to operate a cash bar you are required by the State of California to obtain a liquor license for that event.
    Glass bottled beer and sodas are prohibited.  Use metal cans or plastic bottles only.
    Smoking violations will result in an additional charge of $250 first, $500 second, and $750 third occurrence.  Further occurrences will result in the cancellation of the event.

6.    Regarding the use of uniformed security personnel:


At least two Security Guard will be required for all events unless otherwise stated in your contract.  Three Security Guards will be required for certain types of event.

7.    The facility is leased to you for a period of 12 hours commencing at noon and ending at midnight unless otherwise stated in your contract.

 

    The bar, band, DJ, performers, must stop at the latest a half-hour before midnight and your guests, visitors and vendors will be required to leave the building during this time unless otherwise stated in your contract.
    We need your cooperation in this matter because our cleaning crew will be arriving at midnight.

 

8.    Regarding the setup and breakdown by Decorators/Suppliers for your Event:


    Decorators need to review the rules in item #4 above.
    Decorators/Suppliers are required to remove all items (arches, pillars, etc.) at the end of the event unless other arrangements are made with the Building Manager.
    Lighting specialists must use LED-style lighting only.

 

9.    Candles may be used as table decorations if they are enclosed in glass containers, with water.
